Welcome to GCC Domestic. These Terms of Service govern your use of our platform that connects families, domestic workers, and recruitment agencies across the Gulf Cooperation Council (GCC) region. By accessing or using our services, you agree to be bound by these terms.

1. Acceptance of Terms

By creating an account, browsing our platform, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree with any part of these terms, you must not use our services.

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Your continued use of the platform after changes are posted constitutes acceptance of the modified terms.

2. Eligibility

You must be at least 18 years old to use our services.

You must have the legal capacity to enter into binding contracts in your jurisdiction.

Agencies must hold valid business licenses and necessary permits to operate in their respective GCC countries.

You must provide accurate, current, and complete information during registration and keep your account information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3. User Accounts and Registration

Account Types: We offer different account types for families, workers, and agencies, each with specific features and responsibilities.

Registration: You must provide accurate information including name, contact details, and any required verification documents.

Agency Verification: Agencies must submit business licenses, facility numbers, and other documentation for verification before gaining full platform access.

Account Security: You are responsible for safeguarding your password and must notify us immediately of any unauthorized access.

Account Termination: We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activities.

4. Platform Services

GCC Domestic provides the following services:

• Directory Listings: Verified agency profiles with contact information and service details

• Worker Profiles: Listings of domestic workers seeking employment (where permitted by law)

• Booking System: Interview scheduling and appointment management between families and agencies

• Communication Tools: Secure messaging and contact facilitation

• Search and Matching: Tools to help families find suitable agencies and workers

• Verification Services: Agency license verification and credential checking

We act as a platform connecting parties and do not directly employ or place workers.

5. User Responsibilities

For Families:

• Provide accurate requirements and communicate honestly with agencies and workers

• Comply with local labor laws and regulations regarding domestic worker employment

• Respect workers' rights and treat them with dignity

• Honor commitments made through the platform

For Agencies:

• Maintain valid business licenses and comply with all applicable regulations

• Provide truthful information about workers and services

• Process applications fairly and respond promptly to inquiries

• Protect worker and client information

• Comply with labor laws and ethical recruitment practices

For Workers:

• Provide accurate information about skills, experience, and qualifications

• Be honest in communications with families and agencies

• Fulfill commitments and employment contracts

• Report any issues or violations through proper channels

6. Prohibited Conduct

Users must not:

• Provide false, misleading, or fraudulent information

• Impersonate any person or entity or misrepresent affiliation

• Engage in human trafficking, forced labor, or any exploitative practices

• Discriminate based on race, nationality, religion, gender, or any protected characteristic

• Harass, threaten, or abuse other users

• Use the platform for illegal activities or purposes

• Circumvent verification processes or use fake credentials

• Scrape, harvest, or collect user data without permission

• Interfere with platform operations or security measures

• Post spam, malicious content, or viruses

• Violate intellectual property rights

• Use automated systems or bots without authorization

Violation of these prohibitions may result in immediate account suspension or termination and potential legal action.

7. Payment and Fees

Platform Access: Basic platform access is free for families and workers.

Agency Listings: Agencies may be charged fees for enhanced listings, featured placement, or premium services.

Commission Structure: We may charge commissions on successful placements or bookings made through the platform.

Payment Terms: All fees are non-refundable unless otherwise stated. Payment must be made through approved methods.

Price Changes: We reserve the right to modify pricing with 30 days' notice to affected users.

Taxes: Users are responsible for any applicable taxes on services purchased through the platform.

8. Verification and Background Checks

Agency Verification: We verify agency licenses and business credentials, but cannot guarantee the quality or reliability of services provided.

Worker Information: We facilitate information sharing but do not independently verify all worker credentials. Users are encouraged to conduct their own due diligence.

No Guarantee: Verification does not constitute an endorsement or guarantee of service quality, worker competence, or agency reliability.

User Responsibility: All users must conduct appropriate background checks and verification as required by law and best practices.

9. Intellectual Property

Platform Ownership: GCC Domestic owns all rights, title, and interest in the platform, including design, software, content, trademarks, and logos.

User Content: You retain ownership of content you submit but grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content on the platform.

Limited License: We grant you a limited, non-transferable, revocable license to access and use the platform for personal or business purposes in accordance with these terms.

Restrictions: You may not copy, modify, distribute, sell, or create derivative works from our platform or content without express written permission.

Trademarks: GCC Domestic and related logos are our trademarks. Unauthorized use is prohibited.

10. Third-Party Services

Our platform may integrate with or link to third-party services, websites, or payment processors.

We are not responsible for the content, policies, or practices of third-party services.

Your use of third-party services is governed by their respective terms and privacy policies.

We do not endorse or warrant third-party services and disclaim liability for any issues arising from their use.

11. Disclaimers and Limitations of Liability

Service "As Is": The platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.

No Warranties: We do not warrant that the platform will be uninterrupted, error-free, secure, or free from viruses.

No Employment Relationship: GCC Domestic is a platform facilitator only. We do not employ workers or engage in direct recruitment.

User Interactions: We are not responsible for interactions between users, employment outcomes, or disputes arising from connections made through the platform.

Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Maximum Liability: Our total liability shall not exceed the amount paid by you to us in the 12 months preceding the claim.

Jurisdictional Variations: Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless GCC Domestic, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the platform

• Your violation of these Terms of Service

• Your violation of any rights of another party

• Your content or conduct on the platform

• Any employment relationships or disputes arising from platform connections

13. Platform Modifications and Availability

We reserve the right to modify, suspend, or discontinue any part of the platform at any time without notice.

We may perform maintenance, updates, or improvements that temporarily affect platform availability.

We are not liable for any loss or inconvenience caused by platform modifications or downtime.

We strive to provide advance notice of significant changes but are not obligated to do so.

14. Termination

We may suspend or terminate your account immediately, without notice, for:

• Violation of these Terms of Service

• Fraudulent activity or misrepresentation

• Illegal conduct or abuse of other users

• Non-payment of fees (for paid services)

• Inactivity for extended periods

You may terminate your account at any time through account settings or by contacting support.

Upon termination, your right to use the platform ceases immediately. We may delete your data subject to our data retention policies and legal obligations.

Provisions regarding intellectual property, disclaimers, indemnification, and dispute resolution survive termination.

15. Dispute Resolution and Governing Law

Governing Law: These Terms are governed by the laws of the United Arab Emirates, without regard to conflict of law principles.

Informal Resolution: Before initiating formal proceedings, parties agree to attempt informal resolution by contacting support@gccdomestic.com.

Arbitration: Any disputes that cannot be resolved informally shall be settled through binding arbitration in accordance with the rules of the Dubai International Arbitration Centre (DIAC).

Jurisdiction: For disputes not subject to arbitration, parties submit to the exclusive jurisdiction of the courts of Dubai, UAE.

Class Action Waiver: You agree to resolve disputes individually and waive the right to participate in class actions or representative proceedings.

16. Compliance with Local Laws

Users must comply with all applicable laws and regulations in their respective GCC countries, including:

• Labor and employment laws

• Immigration and visa regulations

• Business licensing requirements

• Data protection and privacy laws

• Anti-discrimination and human rights laws

Country-Specific Regulations:

• UAE: Ministry of Human Resources and Emiratisation (MOHRE) regulations

• Saudi Arabia: Ministry of Human Resources and Social Development guidelines

• Kuwait: Public Authority for Manpower regulations

• Qatar: Ministry of Labour requirements

• Bahrain: Labour Market Regulatory Authority (LMRA) rules

• Oman: Ministry of Labour directives

17. Children's Privacy

Our services are not intended for individuals under 18 years of age.

We do not knowingly collect information from children under 18.

If we discover that a child has provided personal information, we will delete it immediately.

Parents or guardians who believe their child has used our services should contact us immediately.

18. Communication and Notifications

By using our services, you consent to receive communications from us via email, SMS, WhatsApp, or in-app notifications.

Communications may include service updates, booking confirmations, application status, security alerts, and promotional messages (with opt-out option).

You can manage communication preferences in your account settings.

Critical service notifications cannot be disabled.

19. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:

• Natural disasters, pandemics, or public health emergencies

• War, terrorism, civil unrest, or government actions

• Internet or telecommunications failures

• Labor disputes or strikes

• Acts of hackers or cybercriminals

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Invalid provisions shall be modified to reflect the parties' intent to the extent possible under applicable law.

21. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other referenced policies, constitute the entire agreement between you and GCC Domestic.

These Terms supersede all prior agreements, understandings, or representations.
