Is gratuity payable after only 1 year in Oman?
No. Under Ministerial Decision 574/2025 a domestic worker must complete more than two years of service before any gratuity is payable. From that point the rate is half a month (15 days) per year, with partial years pro-rated.
Can my employer deduct damages from my gratuity?
No — gratuity is a legally protected entitlement. Damage claims are separate civil matters and cannot be deducted from gratuity without a court order.
What if my employer refuses to pay gratuity on departure?
File a complaint with MOL at 1502. MOL can prevent the employer from cancelling the work permit until all dues are paid. Cases can escalate to Oman's Labour Court.
Is gratuity calculated on basic salary or total salary?
Gratuity is typically calculated on the basic salary as stated in the employment contract, not including allowances.

⚠️ Common Mistakes
- Using full salary instead of basic. MD 574/2025 calculates on the basic salary — allowances are excluded. For most domestic-worker contracts the stated monthly salary is the basic salary.
- Assuming entitlement starts at 1 year. In Oman the domestic-worker threshold is more than 2 years of continuous service.
- Applying the private-sector rules. Company employees fall under Oman's Labour Law, which has its own end-of-service formula. Domestic workers are covered separately by MD 574/2025.
- Forgetting the non-gratuity dues. Final salary, unused leave balance and the return flight home are owed regardless of length of service.
🏛️ Domestic Workers vs Company Employees
Oman runs two separate end-of-service regimes, and conflating them is the most common source of wrong numbers. Private-sector staff are covered by Oman's Labour Law under Royal Decree 53/2023, which has its own formula. Company employees fall under that law; domestic workers — housemaids, nannies, drivers, cooks and caregivers — are set separately by Ministerial Decision 574/2025: half a month's basic salary for each year of service, payable only after more than 2 years.
